Welcome to MommyMode. These Terms of Use (“Terms”) explain the rules for using the MommyMode mobile application, website, subscriptions, services, features, and related tools (collectively, the “Services”).
MommyMode is operated by MOMMYMODE APP LLC (“MommyMode,” “we,” “us,” or “our”), a New York limited liability company.
By creating an account, using MommyMode, inviting a caregiver or other village member, uploading information, purchasing or using a subscription, or otherwise accessing the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
MommyMode is intended for parents, guardians, caregivers, babysitters, family members, and other family organizers.
You must be at least 16 years old to create or use a MommyMode account. If you are under 18, you may use MommyMode only with the involvement and permission of a parent or legal guardian, or if you are otherwise legally permitted to agree to these Terms where you live.
Children under 16 may not create or manage their own MommyMode accounts.
Caregivers, babysitters, village members, and invited users must also be at least 16 years old. The household owner is responsible for deciding whether an invited person is appropriate, trustworthy, legally permitted to provide care, and mature enough to access family or child information.
MommyMode does not screen, background check, certify, train, supervise, or endorse any caregiver, babysitter, village member, driver, family member, or invited user.
MommyMode is a family organization and caregiving support tool. The Services may help users organize schedules, reminders, routines, child profiles, medications, allergies, care notes, school information, pickup rules, caregiver access, budgets, groceries, meals, documents, transportation information, household tasks, and other family information.
MommyMode is not a medical provider, emergency service, childcare provider, legal service, financial advisor, or professional healthcare service.
MommyMode does not replace your own judgment, a doctor, pharmacist, school, court order, childcare professional, emergency service, or other qualified professional.
In an emergency, call 911 or the appropriate local emergency service.
You are responsible for the information you enter into MommyMode. This may include names, dates, times, medication details, dosages, allergies, emergency contacts, pickup rules, school information, caregiver instructions, documents, payment-related information, transportation information, and household notes.
You agree to keep information accurate, current, and complete.
You should not rely on MommyMode as your only source for medication reminders, allergy information, emergency instructions, pickup rules, transportation plans, childcare decisions, or other safety-sensitive information.
You are responsible for double-checking important information outside the app when appropriate.
You represent that you have the right and authority to provide information that you enter into MommyMode, including information relating to children, dependents, caregivers, or other household members.
MommyMode may allow you to store or organize medication details, dosages, allergies, emergency contacts, care instructions, health information, and related notes.
You are responsible for verifying all medical, allergy, medication, dosage, and emergency information with the appropriate professional or source before relying on it.
MommyMode does not provide medical advice, dosage advice, diagnosis, treatment instructions, emergency monitoring, or healthcare services.
MommyMode is not responsible for missed medications, incorrect dosages, allergic reactions, medical emergencies, caregiver mistakes, user-entered errors, or decisions made based on information stored in the Services.
MommyMode may include artificial intelligence, voice, transcription, suggestion, planning, organization, or automation features.
AI and voice features may misunderstand, mishear, misread, incorrectly organize information, suggest the wrong date or time, miss context, or produce incomplete or inaccurate results.
You are responsible for reviewing, editing, approving, or rejecting AI suggestions before relying on them.
AI suggestions are not final instructions unless you choose to approve and use them.
You should independently verify important dates, times, medication details, allergy details, caregiver instructions, transportation plans, financial information, and emergency information.
MommyMode's AI features are organizational tools and are not substitutes for medical, legal, financial, childcare, or other professional advice.
MommyMode may allow you to invite caregivers, family members, babysitters, co-parents, drivers, or other village members.
The household owner is responsible for choosing whom to invite, what access they receive, which child profiles they may view, and whether it is appropriate to share family or child information with them.
You agree not to invite anyone who should not have access to the household or child information.
MommyMode is not responsible for how invited users use, copy, remember, screenshot, share, or act on information they were permitted to access.
If you remove a caregiver or village member, their future access may be removed, but MommyMode cannot guarantee that information already viewed by that person can be recovered, erased from their memory, or removed from screenshots, copies, messages, or other records they created outside MommyMode.
MommyMode may allow users to upload or store documents, photos, forms, cards, records, notes, or other files.
You should upload only documents you have the legal right or authority to upload and share. This may include school forms, medical forms, insurance cards, identification documents, custody documents, care notes, or other sensitive family records.
Do not upload documents unless they are needed for your family organization and you are comfortable storing them in the Services.
MommyMode is not a legal records system, medical records provider, official school record system, government document vault, or replacement for your original documents.
You should keep your own backup copies of important documents.
Some MommyMode features may require a paid subscription.
Subscription prices, billing periods, trials, promotional offers, and available plans will be shown in the Services or through the applicable Apple App Store or Google Play Store before purchase.
Subscriptions may automatically renew unless canceled before the renewal date through the Apple App Store or Google Play account used to purchase the subscription.
Deleting your MommyMode account, deleting or uninstalling the app, logging out, or not using the Services does not automatically cancel an active subscription.
You are responsible for canceling your subscription through Apple or Google if you do not want it to renew.
Promotional offers, trials, offer codes, and introductory pricing may be subject to additional eligibility requirements, expiration dates, redemption limits, or terms displayed when the offer is made.
Refund requests for purchases made through Apple or Google must be submitted through the app store where the purchase was made and are governed by that store’s applicable refund policies.
MOMMYMODE APP LLC does not directly control Apple or Google refund decisions.
MommyMode subscriptions provide access to the app’s available features during the active subscription period. Using the app, setting up an account, entering household information, inviting caregivers, creating child profiles, using reminders, uploading documents, or otherwise accessing subscription features does not create a guaranteed right to a refund after use.
Refunds are not guaranteed because of minor dissatisfaction, temporary bugs, user error, incomplete setup, misunderstood features, personal preference, forgetting to cancel, not using the app, or deciding after use that the app is not a good fit, except where a refund is required by law or by the applicable app store’s refund rules.
If you experience a technical issue, contact MommyMode at shannel@themommymodeapp.com so we can review and assist.
Repeated refund requests after substantial use, fraudulent purchases, chargebacks, misuse of promotions, or abuse of the subscription system may result in account review, restriction, suspension, or termination where permitted by law and applicable platform rules.
You agree not to misuse MommyMode.
You may not use MommyMode to:
Harass, threaten, stalk, exploit, deceive, impersonate, or harm another person;
Attempt to access another person’s account without permission;
Upload unlawful, harmful, abusive, deceptive, or infringing content;
Interfere with the Services' operation, security, payments, subscriptions, servers, networks, or data systems;
Attempt to bypass access controls, subscription restrictions, permissions, or security features;
Introduce malicious code or intentionally disrupt the Services;
Use the Services in a way that violates another person’s privacy, safety, legal rights, custody rights, or household boundaries; or
Use the Services for unlawful purposes.
We may restrict, suspend, or terminate access where reasonably necessary to protect users, the Services, MOMMYMODE APP LLC, or others, or to enforce these Terms.
You are responsible for maintaining the security of your account, login credentials, devices, and access to your MommyMode account.
You should promptly notify us if you believe your account has been accessed without authorization.
You may delete your MommyMode account from inside the app where available by opening Settings, scrolling to the bottom of the screen, selecting Delete Account, and following the on-screen instructions.
Account deletion and data handling are described in the MommyMode Privacy Policy.
Some information may need to be retained for legal, security, fraud-prevention, transaction, backup, dispute-resolution, or compliance reasons, as described in the Privacy Policy or required by law.
Deleting your MommyMode account does not automatically cancel an active Apple App Store or Google Play subscription.
MommyMode may update, improve, test, change, limit, remove, replace, or discontinue features over time.
We do not guarantee that every feature will always be available, uninterrupted, error-free, perfectly accurate, or compatible with every device, operating system, notification setting, app store, or third-party service.
Reminders, notifications, calendar items, and alerts may fail or be delayed because of device settings, internet connection, operating-system behavior, user error, app-store rules, third-party services, technical issues, or other circumstances outside our reasonable control.
You are responsible for maintaining your own backup systems for important tasks, appointments, medications, pickup rules, emergencies, caregiver responsibilities, and other safety-sensitive matters.
Your use of MommyMode is also governed by the MommyMode Privacy Policy.
The Privacy Policy explains what information may be collected, used, shared, stored, processed, or deleted.
If there is a conflict between these Terms and the Privacy Policy concerning how personal information is handled, the Privacy Policy controls.
The current Privacy Policy is available through the MommyMode website at https://www.themommymodeapp.com.

MommyMode is not responsible for missed reminders, missed appointments, incorrect information entered by users, caregiver decisions, school decisions, transportation issues, medical decisions, emergencies, payment issues controlled by app stores, or actions taken based on information stored in the Services, except to the extent liability cannot legally be excluded.
To the fullest extent permitted by law, MOMMYMODE APP LLC's total liability for any claim related to the Services will not exceed the greater of $100 or the amount you paid to MommyMode during the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of these limitations may not apply to you.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless MOMMYMODE APP LLC and its owners, members, officers, employees, contractors, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the Services, your violation of these Terms, your violation of another person’s rights, information or content you entered or uploaded, your invited users, or your caregiving decisions.
This section applies only to the extent permitted by applicable law.
If you have a concern or dispute, you agree to contact MommyMode at shannel@themommymodeapp.com first so we can attempt to resolve the issue informally.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

We will update the “Last Updated” date when changes are made.
If we make material changes, we may provide notice through the app, website, email, or another reasonable method.
